These Terms of Service ("Terms") are an agreement between you and [Legal entity name], [Registered address] ("we", "us"), which operates AI Smut Generator (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use AI Smut Generator
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You must pass our age verification before you unlock explicit content, save a story or continue a story. See How age verification works.
- You must not use the Service where adult fiction is illegal for you to access.
- One person per account. Don't share your account or sign-in links.
We may refuse, suspend or close an account if we reasonably believe you don't meet these requirements.
2. What the Service is
AI Smut Generator is a text-only tool that uses artificial intelligence to write fiction from your instructions. It does not create images, audio or video. All output is AI-generated, and exports are labeled as such. Output may be inaccurate, inconsistent or not to your taste, and similar prompts may produce similar text for different users.
3. Content rules
You agree to follow our Content Policy, which forms part of these Terms. In short, the Service writes fiction about consenting adult fictional characters only. You must not use it, or attempt to use it, to create content involving:
- anyone under 18, or characters with childlike traits, ages or settings
- real or identifiable people
- non-consent or sexual violence
- incest, bestiality, necrophilia, trafficking or exploitation
- copyrighted text reproduced from published works
You must not try to bypass our safety systems, use automated tools to access the Service, resell access, or use the Service to harass, defame or harm anyone.
We check inputs and outputs automatically. When an automated check flags content, trained staff may review the flagged part only, to enforce these rules. We may block prompts, withhold output, restrict features or close accounts that break the Content Policy. Where the law requires it, we report suspected illegal content to the relevant authorities.
4. Your stories
You own what you write. As between you and us, you keep any rights you have in your prompts and in the stories the Service generates for you, including the right to use them commercially, subject to these Terms and applicable law. AI-generated text may not be protected by copyright in some countries, and we make no promise that it is. Some publishing platforms require you to disclose AI-generated content; that is your responsibility.
What you let us do. You give us a limited, non-exclusive license to store, process and display your content only to provide the Service to you, to keep it secure and to enforce these Terms. We do not use your content to train or fine-tune AI models, and we do not publish or share it.
Private by default. Stories are private to your account. The Service does not currently offer public sharing or publishing.
Responsibility. You are responsible for your prompts and for what you do with the output outside the Service.
5. Plans, payment and cancellation
- Free plan. Guest previews, and after age verification, the daily allowance described on our pricing page. Limits may change with notice.
- Subscriptions (Plus and Pro). Billed in advance each month (or year, if offered) and renew automatically until you cancel. You can cancel in one click in Settings. Cancellation stops future charges; you keep access until the end of the paid period.
- Day Pass. A one-time charge for 24 hours of access. It does not renew.
- Fair use. "Unlimited" plans are subject to fair-use limits that prevent automated, shared or abusive use.
- Billing descriptor. Charges appear as "[Billing descriptor]".
- Payment processing. Payments are handled by third-party processors under their own terms. Crypto payments may be offered and are final once confirmed on the network.
- Price changes. We will notify you at least {notice period, e.g. 30 days} before a price change applies to your subscription. You can cancel before it takes effect.
- Refunds. {Refund policy: e.g. no refunds for partial periods except where required by law; consumer withdrawal rights in the EU/UK and how they are waived when the Service starts immediately at the user's request}. Paid time on an account closed for breaking the Content Policy is not refunded, except where the law requires it.
6. Privacy
Our Privacy Policy explains how we handle personal data, and our Cookie Policy explains the cookies we use.
7. Intellectual property and takedowns
The Service, its software, design and branding belong to us or our licensors. These Terms don't give you any rights in them except the right to use the Service.
We respond to copyright notices under our DMCA Policy and to requests about intimate content of real people under our Take It Down process. We close the accounts of repeat infringers in appropriate circumstances.
8. Ending your account
You can delete your account at any time in Settings. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service for reasons other than your breach, we will give you reasonable notice and a chance to export your stories, and refund any prepaid unused period {confirm with counsel}.
9. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted availability. We don't guarantee that output will be original, accurate or suitable for any use.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the {12} months before the claim or {USD 100}. Nothing in these Terms limits liability that cannot be limited by law, including consumer rights in your country of residence.
11. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the Service, to the extent permitted by law.
12. Governing law and disputes
These Terms are governed by the laws of {governing law jurisdiction}. Disputes will be resolved in {forum / arbitration clause}. If you are a consumer in the EU or UK, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.
13. Changes to these Terms
We may update these Terms. For material changes, we will email you at least {notice period} before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
